H-1 Visa Transfer/Green Card Process

DTG files a petition with the USCIS, for a change of H1 employer, often called a "transfer". You will be asked to submit the following documents:

  • One or two latest pay stubs
  • Copy of all your H1 approval
  • Copy of your Passport ID page and all US visa pages
  • Copies of I-94 records
  • Copy of SSN
  • Latest Resume

DTG's top immigration attorney, Marc W. Simon, Esq, marc@handfinger.com, has compiled a very helpful VISA WORKSHEET. The worksheet helps you gather and arrange all pertinent information to be used in preparing a successful visa transfer request.

  • Prior to Start Date we file for your H1b. Typically this happens about seven business days after you accept our position. Employment with DTG can start when the USCIS filing receipt arrives, usually within 7 days. Upon verification of your US Social Security Number, DTG will include you as a full-time W2 employee in our payroll system.
  • 120 days after your actual start date we begin a 90-day recruitment process. We place required ads in newspapers, file Department of Labor Job Order as well as other recruitment efforts in order to prove to the US Department of Labor that we have offered the position fairly to US citizen. After the recruitment period, we file your Labor Certification Application with the Labor Department using their new automated PERM Process. Approval is often granted within 60 days. The PERM process requires extensive documentation. Your extra effort at this point helps ensure success.
  • Once Labor Certification is approved we file an I-140 form on your behalf. The purpose of this is to petition for an alien worker to become a permanent resident in the United States.
  • If a visa number is available we will file for a change in status (I-485) concurrent with the I-140. If a visa number is not available, the I-485 will be filed as soon as a visa number becomes available.
  • Once your assignment ends, DTG will make every effort to place you on a new assignment, keeping your H1b "in status".
